Definitions “Provider” or “B&G” refers to B&G Technologies. “Customer” or “Client” refers to the entity acquiring B&G supplied services. “Services” refers to any product, service, products or services the customer has acquired or continues to acquire from B&G Technologies. Product or service specific Terms of Service may apply.
By using an B&G Technologies service the client agrees to comply with all B&G Technologies terms of service.
B&G Technologies services, and the infrastructure owned by or a supplier of B&G to supply services is to be used for lawful purposes only. Transmission, distribution or storage of any data in violation of any law is prohibited. This may include, but is not limited to Copyright or trademarked content or data, data or material that is deemed defamatory, obscene or insulting or data or material that constitutes or may be construed as an illegal threat. B&G prohibits the use of supplied services to transmit, distribute or store pirated software, “warez” or “warez” websites, video or audio content for which the client does not hold copyright. B&G prohibits the use of its services for IRC or IRC Bots.
B&G prohibits the use of software, commercial or otherwise or social techniques in conjunction with an B&G supplied service to cause damage to B&G or supplier owned hardware or systems, or the hardware or systems connected to a LAN, WAN or Internet.
B&G reserves the right to suspend any client service that is impacting on the use of any other B&G supplied service, including but not limited to websites using an excessive amount of CPU time, memory or network, without notice. If an agreement can not be made between B&G and the client, B&G reserves the right to terminate the provision of services.
B&G prohibits the use of B&G supplied services to send unsolicited email. B&G reserves the right to suspend compromised accounts that are sending unsolicited email, and may terminate the account if the client cannot readily rectify the problem.
B&G require the client maintain client information when details change, inclusive of contact and billing information. B&G takes no responsibility for service interruption due to outdated customer information, including but not limited to the expiration of domain registrations.
While B&G will make every effort to protect client data stored on or within an B&G supplied service, B&G is not responsible for the integrity of clients data. The client is responsible for maintaining the integrity of clients data, including the frequent provision of backups.
B&G is not responsible for any damages arising from clients use of B&G supplied services, and the client indemnifies B&G as such. All B&G services are supplied “As Is”, and B&G gives no express or implied warranty or service level agreement unless specified by B&G during the time of service order and provisioning.
B&G reserves the right to review, edit and modify this agreement as it deems necessary without notice to the client.
